Agreement

By accessing digitalfossil.co, purchasing or playing our games, joining our communities, or otherwise using our services ("Services"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Services.

The Services

DigitalFossil provides games, marketing sites, and related content. Some experiences are delivered through third-party platforms (such as Steam, console stores, or mobile app stores). Their terms and policies also apply where you obtain or play our games through them.

Accounts and eligibility

Where an account is required, you agree to provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must meet any minimum age required by the platform or your region to use the Services.

User content and conduct

If you submit feedback, bug reports, fan art, messages, or other content ("User Content"), you grant DigitalFossil a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content to operate, promote, and improve the Services, unless we agree otherwise in writing.

You agree not to:

• Harass, threaten, or harm others
• Upload malware, scrape our systems without permission, or disrupt the Services
• Violate intellectual property, privacy, or applicable law
• Cheat, exploit, or reverse engineer our games except where law permits

We may remove content or restrict access if we reasonably believe these Terms are violated or the Services are at risk.

Intellectual property

The Services, including games, art, audio, text, logos, and trademarks, are owned by DigitalFossil or our licensors. Except for the limited rights to use the Services as offered, no rights are granted to you. Do not copy, distribute, or create derivative works except as allowed by law or express written permission.

Purchases and refunds

Purchases made through third-party stores are governed by those stores' payment and refund policies. Any limited warranties or remedies for defective digital content may be subject to local consumer law and platform rules.

Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, DigitalFossil disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

Limitation of liability

To the fullest extent permitted by law, DigitalFossil and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for claims arising out of or related to the Services is limited to the greater of (a) the amount you paid us for the specific product or service giving rise to the claim in the twelve months before the claim, or (b) fifty US dollars, except where liability cannot be limited under applicable law.

Indemnity

You agree to defend and indemnify DigitalFossil against claims, damages, and expenses arising from your User Content, your misuse of the Services, or your violation of these Terms, to the extent permitted by law.

Changes and termination

We may modify these Terms or discontinue parts of the Services. We will post updated Terms on this page with a new "Last updated" date. Continued use after changes constitutes acceptance where allowed by law. We may suspend or terminate access for violations or operational reasons.

General

These Terms are governed by the laws applicable in your primary place of business or residence and DigitalFossil's operating jurisdiction, without regard to conflict of law rules, except where mandatory local rules require otherwise. If any provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver.
